We are The Smug Dog Ltd Trading As The Smug Dog.  We’re a company registered in England and Wales with company number 14284902, whose registered address is at Orchard House, 2 Main Street, Osgathorpe LE12 9TA.  In this privacy notice we will refer to ourselves as ‘we’, ‘us’ or ‘our’.

We take the privacy, including the security, of personal information we hold about you seriously. This privacy notice is designed to inform you about how we collect personal information about you and how we use that personal information.  You should read this privacy notice carefully so that you know and can understand why and how we use the personal information we collect and hold about you. 

We do not have a Data Protection Officer, but if you have any questions about this privacy notice or issues arising from it then you should contact Lola Ojomo, who is responsible for matters relating to data protection at our organisation, including any matters in this privacy notice.  You can contact them using the details set out above. 

We may issue you with other privacy notices from time to time, including when we collect personal information from you.  This privacy notice is intended to supplement these and does not override them.

    The key terms that we use throughout this privacy notice are defined below, for ease:

    Data Controller: under UK data protection law, this is the organisation or person responsible for deciding how personal information is collected and stored and how it is used.  

    Data Processor: a Data Controller may appoint another organisation or person to carry out certain tasks in relation to the personal information on behalf of, and on the written instructions of, the Data Controller. (This might be the hosting of a site containing personal data, for example, or providing an email marketing service that facilitates mass distribution of marketing material to a Data Controller’s customer-base.)

    In this Privacy Policy, "personal data" means any information about an individual whose identity is apparent or can be ascertained, directly or indirectly.

    We collect personal data from you in connection with your access to and use of our websites and online purchases of our products or services, or if you provide us with personal data through other channels or media, such as social media or an event registration service.     To analyse your use of and customise your experience on our websites (the legal basis for this processing is our legitimate interest in better understanding user needs and expectations and improving our websites);

    To develop and manage The Smug Dog's business and operations (the legal basis for this processing is our legitimate interest in understanding shopping behaviour, improving our selection of products and services, and exploring ways to develop and enhance our business);

    To measure your social media engagement with our brand (the legal basis for this processing is our legitimate interest in understanding the efficacy of our marketing strategies);

    To detect, investigate and prevent fraudulent transactions, error, negligence, breach of contract, and other illegal activities and protect against harm to the rights, property or safety of The Smug Dog and our users, customers, employees or the public, including by using video surveillance systems (the legal basis for this processing is our legitimate interest in preventing fraud, error, negligence, contractual breach and other illegal activities and protecting and securing our premises,customers, employees and the public);

    To comply with our legal obligations, including our tax obligations, those related to the prevention of fraud and money laundering, and those required for you to benefit from rights recognized by law, or any regulatory requirements.

    To offer you opportunities to purchase products or services that we believe may be of interest to you, by supplementing the information we collect about you with information from third parties (the legal basis for this processing is our legitimate interest in providing information about products and services that may be of interest to you, unless applicable law requires us to obtain your consent, in which case we will do so).

    Disclosure Of Personal Data

    We do not share personal data about you with third parties except as follows:

    1. Our Service Providers. We share personal data with third parties that perform services for us, including customer support, web hosting, information technology, payment processing, product fulfilment, fraud control, direct mail and email distribution, contest, event, sweepstakes and promotion administration, and analytics services. We only share with service providers the personal data that they need to perform services for us. 

    2. Corporate Transactions. Personal data may be disclosed or transferred as part of, or during negotiations of any purchase, sale, lease, merger, amalgamation or any other type of acquisition, disposal, securitisation or financing involving The Smug Dog.

    3. Professional Advisors. We share personal data with our legal, financial, insurance and other advisors in connection with the kinds of corporate transactions described above or in connection with the management of all or part of The Smug Dog’s business or operations.

If reasonably necessary or required to meet legal or regulatory requirements, resolve disputes, prevent fraud and abuse, or enforce our terms and conditions, The Smug Dog may also keep personal data as required, after an account is closed or is no longer necessary to provide services. Unless otherwise required by applicable law, The Smug Dog will take reasonable steps to destroy or permanently de-identify personal data it holds if such personal data is no longer needed for the purpose for which it was collected.
